1. Acceptance of Terms

Welcome to SafeAus. By accessing or using our mobile application and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and SafeAus. We may update these Terms from time to time, and your continued use of the Service after such updates constitutes acceptance of the modified Terms.

2. Description of Service

SafeAus is a scam detection service designed to help Australian users identify potential scams in:

• Text messages and SMS
• URLs and website links
• Phone numbers
• Images and screenshots

Our Service uses advanced detection methods to assess the likelihood that content is a scam.

3. User Accounts

3.1 Account Creation

To use SafeAus, you must create an account by providing a valid Australian phone number. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorised access
• Be responsible for all activities under your account

3.2 Age Requirement

You must be at least 13 years old to use SafeAus. If you are under 18, you must have parental or guardian consent to use the Service.

4. Acceptable Use

You agree to use SafeAus only for lawful purposes. You will NOT:

• Use the Service to harass, abuse, or harm others
• Attempt to reverse engineer, decompile, or disassemble the Service
• Use automated scripts or bots to access the Service
• Attempt to bypass rate limits or security measures
• Use the Service to check content you do not have permission to access
• Share your account credentials with others
• Impersonate any person or entity
• Upload or transmit viruses or malicious code
• Violate any applicable laws or regulations

5. Service Accuracy and Limitations

5.1 Detection Limitations

SafeAus uses advanced technology to analyse content for potential scam indicators. No detection system can guarantee 100% accuracy.

You acknowledge and understand that:

• Detection systems may not recognise new or evolving scam techniques
• Scammers continuously adapt their methods to evade detection
• Context, nuance, and subtlety in communications may be misinterpreted
• No automated system can replace human judgement in all circumstances

5.2 No Guarantee of Accuracy

SafeAus does not guarantee the accuracy of any scam detection result. Our system may produce:

• False Positives: Legitimate messages incorrectly flagged as scams
• False Negatives: Actual scams that are not detected or are incorrectly marked as "Safe"

A "Safe" result does NOT guarantee that the content is legitimate. You must always exercise independent judgement and verify information through official channels before taking any action, especially involving money, personal information, or clicking links.

5.3 Not Professional Advice

SafeAus provides informational guidance only. Our Service is not:

• Legal advice
• Financial advice
• Professional cybersecurity consultation
• A substitute for your own judgement and common sense
• A guarantee of protection against scams or fraud

5.4 Your Responsibility

You are solely responsible for your decisions and actions based on SafeAus results. SafeAus expressly disclaims all liability for any financial loss, data breach, identity theft, or other harm that may result from:

• Reliance on a "Safe" determination that proves to be incorrect
• Acting upon any result provided by our Service
• Failure to independently verify information before taking action

Always use your best judgement, verify independently, and consult appropriate professionals when needed. We recommend reporting suspected scams to the Australian Competition and Consumer Commission (ACCC) Scamwatch.

6. Free Service

SafeAus is currently provided free of charge. We reserve the right to:

• Introduce paid features or subscription tiers in the future
• Implement usage limits or rate limiting
• Modify or discontinue features at our discretion

If we introduce paid features, we will notify existing users and provide reasonable notice.

7. Intellectual Property

All content, features, and functionality of SafeAus, including but not limited to:

• Software code and algorithms
• Scam detection patterns and models
• User interface and design
• Trademarks, logos, and branding
• Documentation and content

...are owned by SafeAus and protected by Australian and international copyright, trademark, and other intellectual property laws.

8. Family Network

When using Family Network features:

• You can create or join a family group with up to 6 members
• Sharing scam alerts is opt-in and voluntary
• Only metadata is shared (never message content)
• You can leave a family group at any time
• You are responsible for obtaining consent from family members before adding them
• Family members must be 13 years or older

9. Third-Party Services

SafeAus may send content you submit to third-party services for analysis. By using SafeAus:

• You acknowledge that content you check may be sent to third-party services
• These services are subject to their own terms and privacy policies
• We are not responsible for the actions or policies of third-party services

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

To the fullest extent permitted by law, SafeAus disclaims all warranties, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness of results
• Uninterrupted or error-free operation

11. Limitation of Liability

To the maximum extent permitted by law, SafeAus shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Financial losses from falling victim to scams
• Data loss or corruption
• Business interruption
• Loss of profits or revenue
• Damage to reputation

Our total liability for any claims arising from your use of SafeAus shall not exceed AUD $100 or the amount you paid us in the past 12 months (whichever is greater).

12. Indemnification

You agree to indemnify and hold harmless SafeAus, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of third parties
• Your violation of applicable laws

13. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for:

• Violation of these Terms
• Abusive or fraudulent behaviour
• Prolonged inactivity
• Legal or regulatory requirements
• Any reason at our sole discretion

You may delete your account at any time through the app settings or by contacting us.

14. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or your use of SafeAus shall be subject to the exclusive jurisdiction of the courts of Australia.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or in-app notification. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
